Why people leave OneTrust

OneTrust is the best-known consent management platform. It started as a cookie banner and grew into a suite that also covers privacy rights requests, vendor risk, data mapping, governance and AI oversight. Large companies buy it as one system for the whole privacy team, which is why it shows up in so many tenders.

It is run by OneTrust LLC in Atlanta. The contracting table on its legal page assigns the contracting entity by where the customer is based: OT Technology, Inc. in Atlanta, under Georgia law, for the Americas, and OT Technology Spain S.L.U. in Madrid for Europe, the Middle East and Africa, except the UK, Guernsey and Jersey.

That Spanish contract is governed by the laws of England and Wales, with the courts of England and Wales. The UK is outside the EU.

For data leaving the EU, OneTrust says it relies on adequacy decisions, including its own self-certification under the Data Privacy Framework, and on standard contractual clauses where there is none. That is a lawful route, but it is a route that depends on a framework which has been challenged before. This page is about the consent part only: the banner, the script blocking and the consent record. Eleven European platforms do that job.

  • The contract is Spanish, the law is English If you are in the EU, your counterparty is a Spanish subsidiary, but the governing law and the courts named in OneTrust's contracting table are those of England and Wales. A dispute would not be decided in your own legal system. With the platforms below, the contracting entity sits in an EU country, with the exception of Borlabs, where the order itself goes through Paddle as merchant of record.
  • Transfers rest on a framework, not on geography OneTrust states that it relies on adequacy decisions, including its Data Privacy Framework self-certification, and on standard contractual clauses otherwise. A European consent platform that hosts in the EU does not need that route for its own processing. That does not make it better at the job, but it removes one assumption from your records of processing.
  • You may be buying a suite for a banner OneTrust is built for privacy teams with data mapping, assessments and vendor risk on top of consent. A company that needs a compliant banner, script blocking, a consent log and Google Consent Mode may pay for far more than it uses. Several European tools below publish a price per site or per month, which OneTrust's legal pages do not.
  • The European answers are not one product Didomi and Cookie Information are enterprise platforms in the same bracket as OneTrust's CMP. Usercentrics, iubenda, CookieScript, consentmanager, Axeptio and CookieFirst are subscription CMPs for small and mid-sized sites. Borlabs Cookie and Complianz run inside WordPress, and Klaro has an open-source core. Four of the eleven (iubenda, consentmanager, CookieFirst and Complianz) sit in one group, so they are less independent of each other than their names suggest.

What you have to replace, not just match

Start by listing what you use OneTrust for. If it is only the banner and the consent record, any tool here will do and the switch is a weekend. If it also runs your data subject request portal, your vendor assessments or your records of processing, the consent part moves and the rest does not, so plan a second tool or stay with OneTrust for those modules.

Before you switch, export your consent logs and keep them for as long as your retention policy says. A new platform starts a new record, and you may be asked for the old one. Rebuild your cookie categories from a fresh scan rather than copying the old list, run the old and new banner on a staging site, and check that scripts are blocked before consent, not after.

What actually breaks when you switch

Moving a banner is easy. Moving the record is not. Your new platform will not import OneTrust's consent log, so export it first and keep it as long as your retention policy says. Expect the first weeks to show a dip in consent rates while visitors see a new banner.

If OneTrust also handles your privacy requests, assessments or vendor reviews, leaving only the consent module leaves those with it. Decide whether you want a second tool, a spreadsheet, or to stay put for those modules.

Is there a European tool that does everything OneTrust does?

No. OneTrust covers consent, privacy requests, assessments, vendor risk, data mapping and AI governance in one suite. The closest European match for the consent and TCF side at enterprise scale is Didomi, with Cookie Information in the same bracket. Neither is a full privacy-management suite in OneTrust's sense.

If you only need consent, the choice widens a lot, and the cost drops. Check which of OneTrust's other modules you really use before you decide that you need a replacement for them.

Which of these have a free plan or a trial?

I run WordPress. Which should I look at first?

The difference is where the consent record lives. A plugin keeps it on your own site. A hosted platform keeps it with the vendor, which helps if you manage many sites and hurts if you wanted nothing to leave your server.

Does the vendor's location matter for a cookie banner?

It matters for two reasons. The banner is the first thing that runs on your site, and its provider sees visitor data. And the consent record is evidence you may need in front of a regulator. A contracting entity and hosting inside the EU keep that evidence and that processing within one legal system.

It is not the only criterion. The platform has to block scripts before consent and keep a usable log. A European address does not substitute for either.

Be realistic about the gap. None of the eleven replaces OneTrust's privacy-request, risk and governance modules, and the argument for leaving is a legal and cost one, not a feature one: a European contracting entity, a record that stays in the EU, and a price list.
